All reservations are pending until the credit card entered has been validated and processed for the deposit due at the time of booking.

  • Prices and Taxes...the occupancy tax collected is 14.45% which includes the state tax 5.7%, the local town tax 6% and the Cape and Islands Water Protection Fund Tax 2.75%

  • Payment and Terms at Check-in/Check-out...all reservation fees and taxes are collected at the time of booking and refunded to the credit card used for the booking if the reservation is cancelled within the grace period listed in the cancellation policy.

  • Traveling with Minors Policy 
    At Frederick William House, we welcome families and guests traveling with children. To ensure a safe and pleasant experience for all guests, we kindly ask that you review and comply with the following policies when traveling with minors:
    1. Supervision Required: All minors (under the age of 18) must be accompanied by a parent or legal guardian at all times while on the property. Unaccompanied minors are not permitted to check in, stay, or remain on the premises without adult supervision.
    2. Adult Responsibility:The registered adult guest assumes full responsibility and liability for the conduct, safety, and supervision of any minors in their party throughout the duration of the stay. This includes responsibility for any damages or disturbances caused by minors.
    3. Age Restrictions for Booking: Guests must be at least 18 years old to reserve and check in to a room, in accordance with our property standards and under the hotel’s right to establish reasonable occupancy rules as permitted by M.G.L. Chapter 140, Section 6.
    4. Safety Guidelines:For the safety of all children on-site, we ask that guardians ensure minors do not run, climb, or play unattended on staircases, near driveways, or in any common areas. Use of hotel-provided bicycles or equipment is at the discretion and supervision of the parent/guardian, and at their own risk.
    5. Quiet Hours:Families are asked to observe quiet hours between 10:00 PM and 8:00 AM to respect the experience of other guests.

    • Our main guest accommodations are located in a historic building that may present challenges for individuals with limited mobility, including stairs and narrow entryways.

    • At this time, we do not have an elevator, and not all rooms are wheelchair accessible. Guests with mobility concerns are encouraged to contact us prior to booking so we can discuss specific needs and recommend the most suitable accommodations.

    • We make every reasonable effort to accommodate guests with special needs, including:

      • Ground-floor rooms (based on availability)

      • Early check-in or late check-out when needed for medical or mobility reasons

    • Service animals, as defined under the ADA, are always welcome. Emotional support animals must be approved in advance.

    While we make every effort to maintain a safe and well-lit parking area, Frederick William House assumes no responsibility or liability for any loss, theft, or damage to vehicles or their contents while parked on the property.
    By parking a vehicle on-site, guests acknowledge and agree that:

    Frederick William House provides a warm and elegant setting for intimate gatherings and special occasions. To protect the peaceful atmosphere of our property and ensure the safety, comfort, and privacy of all guests, any event held on-site must be booked directly as a “venue rental.”
    Events That Require Venue Booking:
    The following types of events are not permitted under standard lodging reservations and must be arranged through our venue team:

  • Conduct & Dispute Resolution Policy... At Frederick William House, we strive to provide an exceptional guest experience and encourage open communication regarding any concerns or dissatisfaction. We welcome feedback provided in good faith and through proper review platform channels. However, we do not Attempts to resolve disputes through defamatory, slanderous, or extortive behavior, will not be tolerated.
    Guests agree not to use online reviews, social media, or other public forums to threaten, coerce, or extort the business or its staff. This includes the posting or threatening of negative reviews in an attempt to receive unearned discounts, refunds, or other compensation.
    Such conduct is considered unlawful under Massachusetts General Laws Chapter 265, Section 25, which defines criminal extortion as knowingly and maliciously threatening injury to reputation to obtain something of value. Furthermore, defamatory statements made with malicious intent may be actionable under Massachusetts common law and subject to civil liability.
    We encourage all guests to bring any concerns directly to management so that we may address them promptly and professionally. Abuse of review platforms or social media to resolve private disputes may result in legal action to protect the reputation and integrity of our business. Any matters requiring formal resolution by the guest will be handled through arbitration. Frederick William House reserves the right to pursue legal action in appropriate circumstances, including but not limited to property damage, non-payment, or violation of terms. By staying at Frederick William House, guests agree to abide by this policy.

      3. Use of Amenities...Use of any provided amenities (e.g., bicycles, fire pits, outdoor games, or shared spaces) is voluntary and at the guest’s own risk. Guests are expected to follow safety guidelines and exercise common sense. Misuse may result in injury for which Frederick William House assumes no responsibility.
      4. Weather & Acts of Nature & Acts of God...We are not liable for disruptions, cancellations, or damages caused by extreme weather, natural disasters, power outages, or other acts beyond our control or personal health complications that may interrupt travel. 
      5. Massachusetts Legal Compliance...This liability disclaimer is provided in accordance with Massachusetts General Laws Chapter 231, Section 85, which permits businesses to limit liability for certain types of harm when guests are made aware of the risks and no gross negligence is involved.
      By staying at Frederick William House, guests agree to hold harmless the owners, staff, and affiliated personnel from liability for any injury, loss, or damage incurred during their visit, except where prohibited by law.

  • Force Majeure...Force Majeure Policy – Frederick William House shall not be held liable for failure to perform or fulfill any obligation under its lodging or venue rental agreements if such failure is caused by circumstances beyond its reasonable control.

    This policy is in accordance with the common law doctrine of impossibility of performance and commercial frustration as recognized in Massachusetts contract law, and may also be supported by M.G.L. Chapter 106, Section 2-615 (Excuse by Failure of Presupposed Conditions).

    • Governmental orders or restrictions (e.g., travel bans, building closures, public health emergencies)

    • Delays or failures by third-party vendors or services

    • Cancel or modify reservations or event agreements without penalty

    • Offer credits or rebooking options (when possible), rather than monetary refunds

    • Prioritize the health, safety, and legal obligations required during such an event

  • Third Party Rights Policy – Frederick William HouseThe terms and conditions of any reservation, event agreement, or service provided by Frederick William House apply solely to the registered guest(s) or contracting party and do not confer any rights or responsibilities upon third parties, whether individuals, vendors, or outside entities.
    1. No Implied Rights for Third Parties
    Only individuals listed on the reservation or official venue agreement are entitled to access the property, amenities, or services provided. No third party shall acquire any rights, benefits, or remedies under or in connection with your reservation.
    2. Vendors, Visitors & Outside Services
    Guests may not invite outside vendors, entertainers, planners, caterers, photographers, or other service providers onto the property without prior written approval. All third-party access is subject to our property’s rules and must be coordinated directly through Frederick William House management.
    3. No Assignment or Transfer
    Reservations, special offers, event bookings, or other contractual rights may not be transferred or assigned to another person, business, or organization without express permission.
    4. Legal Reference
    This policy is in line with Massachusetts contract principles and supported by the doctrine of privity of contract, which holds that only parties to an agreement have enforceable rights or obligations under it.

     

  • Waiver of Liability – Frederick William HouseBy entering the premises of Frederick William House, located at 594 Palmer Ave, Falmouth, MA, and/or participating in any activity or service provided by the property, guests voluntarily agree to the following Waiver of Liability:
    1. Assumption of Risk
    Guests understand that staying in a historic property and engaging in any on-site activities—such as walking the grounds, using bicycles, fire pits, or participating in private events—involves inherent risks. Guests voluntarily assume full responsibility for any injury, illness, damage, or loss that may occur during their stay, regardless of cause.
    2. Release of Liability
    To the fullest extent permitted by law, guests agree to release, waive, discharge, and hold harmless Frederick William House, its owners, agents, employees, and affiliates from any and all claims, liabilities, or demands arising from:

  • Severance...If any provision of this agreement, policy, or set of terms is found to be invalid, such provision shall be deemed severed from the remainder of the agreement. All remaining provisions shall remain in full force and effect and shall not be affected or impaired in any way. This clause applies to all policies, waivers, terms and conditions, and agreements issued by Frederick William House and is enforceable under Massachusetts contract law. Any matters requiring formal resolution by the guest will be handled through arbitration. Frederick William House reserves the right to pursue legal action in appropriate circumstances, including but not limited to property damage, non-payment, or violation of terms.
